Meebz Coffee Roasters Terms and Conditions

General

Meebz Coffee Limited trading as Meebz Coffee Roasters (Meebz) grants you a non-exclusive, limited, and revocable license to use and access the website and online ordering platform (collectively known as the ‘Meebz website’). In these Terms and Conditions, “us”, “we” and “our” refer to Meebz, and references to “you” and “your” are to you, the end user. These Terms and Conditions are made in accordance with the laws prevalent in New Zealand.

Agreement Between Meebz and You When Using the Meebz Website

By accessing and using the Meebz website, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, you must immediately stop using the Meebz website. We may change, update, or otherwise amend the Meebz website at our absolute discretion and without notice.

Meebz’s Goods and Services Provided to You

Meebz may offer you access to goods and services for sale or access to controlled areas of the Meebz website. To accept any offer made by Meebz and access these goods and services, you must provide Meebz with all requested information and register this information via the Meebz website.

Meebz’s Terms of Sale in Respect of Any Good or Service Offered via the Meebz Website

You may purchase goods and services online from the Meebz website. All purchases are subject to the following terms:

  • All prices displayed on the Meebz website are in NZD.
  • Any purchase of items from the Meebz website (an ‘order’) is confirmed only when you complete payment for the items and for delivery. Payments must be made by credit card or via PayPal.
  • Meebz will not honor any order which has not been paid for in full.
  • Meebz shall advise you of any delivery fees prior to dispatch, and these are advertised prior to the payment of your order.
  • You must provide accurate delivery information. Meebz will only deliver to your residential or office delivery address within the delivery zone.
  • The delivery zone is an area as defined by the Meebz website. Meebz does not agree to delivery outside of the delivery zone.
  • Delivery of your order will take place within the prescribed dates and times as specified on the Meebz website:
    • All orders placed before 9:00am are dispatched the same day and are delivered according to our shipping policy and we aim to get each order out as quick as we can.  If we do not have stock or for superlative coffee's, your order may take an extra few days.
    • If you are not home upon delivery, the courier company may leave your parcel in a hidden location and this could include but not limited to the back door, behind pot plants, under a BBQ or a location not easily seen by the public.
    • You agree to take responsibility for any risk of damage or loss of the order once the order has been delivered to your address.
    • Meebz is not responsible for any loss, damage, inconvenience, or similar detriment as a result of incorrect instructions provided by you to Meebz (examples include but are not limited to incorrect delivery address, incorrect contact information, incorrect starting date selected by you).

Cancellations or Delivery Date Changes

Cancellations or changes to the delivery date can only occur before we dispatch the goods and we recommend you contact us ASAP if you need to cancel or change your order.

Your Responsibility After Your Order Has Been Delivered by Meebz

  • You must ensure that the coffee beans are stored correctly to maintain their freshness. Any delays in proper storage (examples include but are not limited to not being home when delivery takes place, picking up your order but not storing immediately) which result in poor quality coffee beans will not be reimbursed by Meebz in any way.
  • Meebz coffee beans are guaranteed fresh for a certain period after delivery. It is your responsibility to ensure all Meebz products are stored correctly ideally airtight, away from direct sunlight and not in the fridge or freezer.

Conditions of Using the Meebz Website or Any Meebz Product

  • You must place an order with Meebz to receive any product or service from us.
  • You may only use the Meebz website and/or any Meebz product for lawful purposes.
  • You must not engage in any improper or indecent behavior across the Meebz website, Meebz social media accounts, or by using the Meebz products in any way.
  • You will not attempt to harass or bully any Meebz team member or Meebz customers.
  • You may only represent yourself when using the Meebz website or ordering Meebz products. You may not use aliases, another person’s identity, or provide any other false information.
  • All data and content contained on the Meebz website and in the Meebz products remains the sole property of Meebz, this includes logos, images, video, written content, prices, and all other items not listed here, unless otherwise stated.
  • You may not use the Meebz website or Meebz products for any commercial purpose unless authorised.
  • Purchase of any Meebz product or service entitles that purchaser to the use of that product or service. This entitlement does not extend to any other person. Any purchaser/s must not use Meebz products for any commercial purposes.
  • Meebz maintains the Meebz website for the purpose of running the Meebz business. Meebz makes no guarantees of or takes responsibility for continuing site availability, the unavailability of the Meebz website, or any other ordering system with respect to Meebz products that results in any loss.
  • From time to time, Meebz engages in promotional activities with third parties. Any representations made by these third parties do not constitute representations by Meebz and vice versa. By using the Meebz website, you consent to information and advertising from these third parties, which may or may not be endorsed by Meebz. Meebz does not take any responsibility for any loss or damage experienced by you in relation to these third-party entities.
  • You indemnify Meebz against any loss for any breach of these conditions. Meebz will take necessary legal action should we believe any of these conditions have not been met.

Further Information and Limitations of Your Liability and Meebz’s Liability

  • You agree that you use the site at your own risk. You acknowledge that we are not responsible for the conduct or activities of any Meebz customer and that we are not liable for such under any circumstances. You are solely responsible for the use of the Meebz ordering system, irrespective of who is utilizing it on your behalf and/or using your personal information and payment information, whether with or without your permission.
  • You agree to indemnify us for any loss, damage, cost, or expense that we may suffer or incur as a result of or in connection with your use of or conduct in connection with the site, including any breach by you of these Terms and Conditions. Certain rights and remedies may be available under the Consumer Guarantees Act 1993 or similar legislation and may not be excluded, restricted, or modified. Apart from those that cannot be excluded, we and our related entities exclude all conditions and warranties that may be implied by law. To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is restricted, at our option, to:
    • the re-supply of services or payment of the cost of re-supply of services; or
    • the replacement or repair of goods or payment of the cost of replacement or repair.

Your Privacy

Meebz does not share customer data or customer payment details with any other third party without the express consent of that customer.

The Meebz website is powered by Shopify, and the Meebz payment system is powered by Shopify Payments. Meebz encourages all users to familiarize themselves with the respective terms and conditions of these entities.

Meebz’s Disclaimer

These terms and conditions are not legal advice, nor do they attempt to circumvent any law in the relevant jurisdiction.

Any provision of these Terms and Conditions, which is invalid or unenforceable in any jurisdiction, is, as to that jurisdiction, ineffective to the extent of the invalidity or unenforceability without affecting the remaining provisions of these Terms and Conditions or affecting the validity or enforceability of that provision in any other jurisdiction. The parties will negotiate in good faith to replace any such provision with a provision which is valid and enforceable and consistent with the intention of these Terms and Conditions, so far as is reasonably practicable.

These Terms and Conditions form part of an ecommerce transaction, and the parties agree that these Terms and Conditions shall be accepted electronically and the agreement to these Terms and Conditions is formed and validly entered into electronically.

Meebz may end the agreement formed by Terms and Conditions immediately by giving you written notice. It is not essential to provide reasons for the termination. Where these Terms and Conditions have been terminated, you must immediately cease using the site or services.

Your use of the Meebz website may be canceled at any time, for any reason, on a temporary or permanent basis. You must immediately cease using the site should you receive a notice canceling your license to use the site.

Meebz may update these terms and conditions from time to time. Meebz strongly recommends reading these terms before placing each order.

SMS Marketing

By providing your phone number, you agree to receive marketing messages from Meebz Coffee Roasters via SMS. These messages may include promotions, special offers, updates on new products, and other relevant information about our coffee and services. Standard message and data rates may apply. You can opt out of receiving these messages at any time by following the instructions provided in the SMS or by contacting us directly at info@meebz.co.nz. We respect your privacy and are committed to protecting your personal information, which will only be used in accordance with our Privacy Policy.

Contact

You may contact Meebz via phone or email only in relation to any queries regarding these terms and conditions or for any queries relating to your order. Contact via social media is not recognized by Meebz as a valid form of communication. The email account mtan@meebz.co.nz is monitored during normal business hours.
